ORBITA, ABRAHAM B. “THE ADMINISTRATION OF PHILIPPINE NATIONAL POLICE REFORM MANAGEMENT OFINTERNAL AFFAIRS SERVICE IN THE DISPENSATION OF ADMINITRATIVE CASES”,

One of the organizations created to man peace and security in the country is the Philippines National Police (PNP). The men and women of PNP is committed to a vision of a professional ,dynamic and highly motivated Philippine National Police, working in partnership with a responsive community towards the attainment of a safe place to live, work, invest and do business with. Its mission is to enforce the law, to prevent and control crimes, to maintain peace and order, and to ensure public safety and internal security, with the active support of the community. Anent the cited vision and mission, the PNP is mandated to do so with efficient service, honor and justice while at all times conducting themselves with the highest ethical standards to maintain public trust and confidence. The agency had undergone several overhauling processes to better maintain its integrity and provide the desired services the public is expecting of its men-in-uniform workforce.one of the products of the cited processes is the Integrated Transformation Program (ITP). One of the key results areas of the said program aside from the human resources development is Reform Management.

This study examined the implementation policies and procedures of the various reform management functions of the Internal Affairs Services (IAS) in the dispensation of administrative cases of the uniformed PNP personnel in the province of Albay. Specifically, it answered the following questions: 1) What are the administrative cases handled by IAS in the province of Albay in terms of nature and number? 2) What is the status of implementation of the reform management policies and procedures of IAS in the handling of administrative cases along Complaint Management, investigation Management, Evaluation Management, and Disposition Management? 3) What is the level of effectiveness of implementation of the reform management policies and procedures of IAS in the province of Albay in the handling of administrative cases along the cited indices? 4) What are the implications of the status and level of effectiveness of the implementation of the reform management policies and procedures of IAS to the Internal Disciplinary System of PNP? And, 5) What development strategies may be recommended to enhance the reform management policies and procedures implemented by IAS along the above-cited indices?

Several individuals and organizations were identified to benefit from this study. As to the process, the study used the descriptive-evaluative method of research. It utilized the theories of Evaluation by Wholey and Rossie, Total Quality Customer Service Concept of Ivade King Taylor, and the Ginter and Duncan’s Theory. The Theoretical Framework of the study was anchored on said theories. The Conceptual and Analytical Framework, which were considered contributions to the knowledge base of research, which were built reflecting the problems of the study. The study identified several individuals and institutions as beneficiaries of this research.

Several sources of data were tapped. The primary data were gathered from the responses of a total 95 respondents consisting of 15 personnel of Internal Affairs Services police Provincial Office; and, 80 uniformed rank-and-file personnel of PNP-Albay who ad administrative charges pending resolutions and/or implementations of the decisions by the Internal Disciplinary Authorities of the PNP. Secondary data were gathered from various documents such as publications, manuals, magazines, memoranda, circulars, list of pending administrative cases at the regional offices of IAS, unpublished theses and dissertations. The Internet was also tapped specially for the foreign related literature and studies. The analyses of these various sources led the researcher to determine the gap of the study.

In order for the researcher to give credence to the data gathered several statistical tools were used such as frequency count, rank, percent and weighted mean. The weighted mean was computed using the Microsoft Excel program.

The following are the findings of the study:

1. The profile of administrative cases managed and handled by IAS – PPO Albay for the year 2006 were 44 due to misconduct or conduct unbecoming, two (2) for dishonesty, there(3) for neglect of duty, none for obstruction of justice ,and three (3) for irregularities in the performance of duty; while in 2007, 67 for misconduct of conduct unbecoming, five (5) for dishonesty,25 for neglect of duty, one (1) for obstruction of justice, and 12 for irregularities in the performance of duty; while in 2007,67 for misconduct unbecoming ,five (5) for dishonesty,25 for neglect of duty, one (1) for obstruction of justice, and 12 for irregularities in the performance of duty for the year 2007.

2. The functions of Reform management along Complaint Management (4.12), Investigation Management (3.87), Evaluation management (3.92) and Disposition Management and their respective policies and procedures by IAS were “implemented.”

3. The level of effectiveness of the implementation of functions of the Reform Management along effective Complaint Management (3.85), Investigation management (3.74), Evaluation management (3.77) and their respective policies and procedures by IAS was “high.”

4. the implications of the study’s findings on the status and level of effectiveness of the implementation of functions, policies and procedures by IAS of the PNP’s Reform Management were of substantial and considerable outcomes towards enhancement of the Internal Disciplinary System of the Philippine National Police.

5. The development strategies recommended to enhance the functions of Reform management policies and procedures implementations of IAS for Complaint Management were: Create a complaint center to assist parties in writing a well-ordered and systematic letter as required by the rules and regulations in filing complaints; The PNP IAS should exert effort to control “forum shopping” effects to the aggrieved party; The PNP should be particularly in entertaining complaint that only passed the rigidly of requirements in accordance with rules and regulations of PNP; and, The PNP IAS should take extra efforts in analyzing complaint with promptness.

For Investigation Management, the recommended strategies were: Institute panel to undertake pre-charge investigation; Create a committee to undertake complaint verification process; adopt a procedure whereby all relevant facts and information are at hand even without the additional witness; and, Establish an on-line system. Recommended also was to institute a procedure wherein all relevant questions are covered in just one setting.

For Evaluation Management, the recommended strategies were: Create an evaluation committee; Institute a system wherein authentication of documents is done once; Adopt a procedure whereby all relevant facts and information are at hand even without the additional witnesses; and, Establish an on-line system. Recommended also was to institute a procedure wherein all relevant questions are covered in just one setting.

For Evaluation management, the recommendation strategies were: Institute panel to undertake pre-charge investigation; Create a committee; Institute a system wherein authentication of documents is done once; Adopt a procedure whereby all relevant facts and information are at hand even without additional witnesses; adopt a pool of counsels; and, assess timeless appropriate for different cases evaluated.

And, for Disposition Management, the recommended strategies were: Provide provincial IAS authority to undertake some functions like proceeding to formal hearing based on meritorious reason; etc.,; Complaint of utmost concern to PNP should be decided at once even without the respondent’s counter affidavit; Limit procedural activities in deciding administrative charges of utmost concern to PNP should be decided at once even without the respondent’s counter affidavit; Limit procedural activities in deciding administrative charges of utmost concern to PNP; Establish and effective management information system; provide functional and efficient feedback mechanism on tried cases.

6. An action plan to enhance the different functions of the Reform Management have been prepared and recommended for implication.

The following are the conclusions of the study:

1. The nature of administrative cases for the rank-and-file uniformed PNP personnel handled by IAS for the period from 2006 to 2007 was in accordance with Rule Section 1 of the Rules of Procedure in the Investigation and Disposition of Administrative Complaints against Uniformed Personnel of the PNP before the IAS (Memorandum Circular No. 2002-013) pursuant to Section 39 of the “Philippine National Police Reform and Reorganization Act of 1998” or Republic Act No.8551.

2. The implementation of the functions of reform management and their respective policies and procedures in handling of the administrative cases for rank and file uniformed PNP personnel by IAS were 61-80% implemented in such manner that were actually intended in accordance with the rules of procedures of PNP Reform management.

3. The level of effectiveness of implementation of the functions of reform management policies and procedures in handing the administrative cases for rank-and-file uniformed PNP personnel by IAS provided the intended/expected results and effects to the just and fair resolution of the same cases.

4. The implications of the results of the study particularly on the status and level of effectiveness of implementation of Reform Management’s functions policies and procedures by IAS are noteworthy and important contributions to the Internal Discipline System of the Philippine national Police.

5. Several development strategies were recommended to enhance the Reform management’s functions’ implementation of policies and procedures I handling administrative cases by IAS.

6. There is an action plan that could be used to implement the strategies to enhance the implementation of Reform management of PNP.



The following are the recommendations of the study:

1. The Internal Disciplinary Authority of the PNP should regularly conduct a strategic review of the cases handled by IAS and the results of the Reform management by all levels of disciplinary authorities to effect better and gain cooperation with other major service departments of the PNP.

2. The regional IAS should conduct a regular review of the activities and practices of each aspects of reform as embodied in the Integrated Transformation program of the PNP to consider the possibility of redefining policies and procedures that are deemed unnecessary an adopt and adopt the study’s recommended action plan to enhance the prevailing Reform management policies and procedures were found weak.

3. The department heads of the responsive police station units of the PNP should assist IAS in the implementation of the Reform and Transformation Programs by identifying the needs of the employees within their units and conduct objectives feedback activities particularly on the evaluation results and development of personal plan of the workplace.

4. The PNP uniformed should continuously grow and develop personally by updating and upgrading their competence and behavior toward work and consider the same as opportunities to achieve their career goals with the PNP.

The following areas are suggested for further research:

1. A replication of the study with other government agencies in the Bicol Region.
2. An in-depth study of the Human Resource management Training and Development Programs of the PNP in the Bicol Region.
3. An in-depth study of the Operation management practices and activities of the PNP in the Bicol Region.
4. An in-depth study on the Integrated Transformation Program of the PNP in the Bicol Region
